2. Service Agreement and Estimates
Estimates
We provide free estimates for our services. Estimates are valid for 30 days from the date provided unless otherwise specified. Final pricing may vary based on site conditions discovered during the work.
Service Agreements
All work is performed under a written service agreement that includes:
- Detailed scope of work
- Materials specifications
- Timeline for completion
- Total cost and payment terms
- Warranty information
3. Payment Terms
Payment Methods
We accept various payment methods including cash, check, and major credit cards. Payment terms will be specified in your service agreement.
Payment Schedule
Payment schedules vary by project size:
- Small projects (under $2,000): Full payment upon completion
- Medium projects ($2,000-$5,000): 50% deposit, balance upon completion
- Large projects (over $5,000): Payment schedule outlined in service agreement
Late Payments
Late payments may be subject to a service charge of 1.5% per month on the outstanding balance.
4. Warranties and Guarantees
Workmanship Warranty
We provide a warranty on our workmanship for a period specified in your service agreement, typically:
- New gutter installations: 5 years on workmanship
- Repairs: 1 year on repaired components
- Gutter guard installations: 2 years on workmanship
Material Warranties
Materials are covered by manufacturer warranties. We will assist with warranty claims but are not responsible for manufacturer defects.
Warranty Limitations
Warranties do not cover:
- Damage from severe weather events
- Normal wear and tear
- Damage from improper maintenance
- Damage from third parties
- Changes requested by the customer after completion
5. Customer Responsibilities
Customers are responsible for:
- Providing accurate information about the property
- Ensuring clear access to work areas
- Removing valuable or fragile items from work areas
- Providing electrical power and water access if needed
- Notifying us of any underground utilities or hazards
- Maintaining gutters according to our recommendations
6. Scheduling and Delays
We make every effort to complete work as scheduled. However, completion may be delayed due to:
- Weather conditions
- Material availability
- Unforeseen site conditions
- Customer-requested changes
- Permit delays
We are not liable for damages resulting from reasonable delays beyond our control.
7. Cancellation Policy
Customer Cancellation
Customers may cancel services:
- Before work begins: No cancellation fee if cancelled within 3 business days
- After work has begun: Customer responsible for work completed and materials ordered
- Emergency services: No cancellation allowed once technician is dispatched
Company Cancellation
We reserve the right to cancel services if:
- Site conditions are unsafe
- Customer fails to meet payment obligations
- Customer is abusive or threatening to our staff
- Required permits cannot be obtained
8. Limitation of Liability
Our liability is limited to the cost of the services provided. We are not liable for:
- Consequential or indirect damages
- Lost profits or business interruption
- Damage to landscaping (unless caused by our negligence)
- Pre-existing conditions not disclosed by customer
- Acts of nature or severe weather events
9. Insurance and Licensing
Gulf Coast Seamless Gutters maintains:
- General liability insurance
- Workers' compensation insurance
- Appropriate state and local licenses
- Bonding as required by law
10. Dispute Resolution
Informal Resolution
We encourage customers to contact us directly to resolve any concerns.
Mediation
If direct communication fails to resolve disputes, both parties agree to attempt mediation before pursuing legal action.
Governing Law
These Terms are governed by the laws of the State of Florida. Any legal proceedings must be brought in the appropriate courts of Florida.
11. Safety and Compliance
We adhere to all applicable safety standards and regulations, including:
- OSHA safety requirements
- Local building codes
- Environmental regulations
- Waste disposal requirements
12. Changes to Terms
We may update these Terms from time to time. Updated Terms will be posted on our website with a new effective date. Continued use of our services after changes constitutes acceptance of the new Terms.
13. Severability
